What is substitute performance?
Employment Act and Company Obligations
All companies with more than 25 employees are required to comply with the Employment Act. This law mandates, among other things, that companies employ at least 4% of employees with disabilities. If an employer fails to meet this obligation, they must pay a contribution to the state budget, which can be understood as a penalty for non-compliance.
Amount of the Contribution
- The contribution is set at 2.5 times the average wage, which is announced annually by the Czech Statistical Office.
- The calculation of the contribution is made for each disabled person that the employer has not employed.
Alternative Solution: Substitute Performance
In cases where an employer cannot directly employ persons with disabilities, the law offers the option of so-called “substitute performance”. This obligation can be fulfilled by:
- Purchasing goods and services from employers whose workforce consists of more than 50% employees with disabilities.
- A combination of partial payment and substitute performance.
Substitute performance is regulated by § 81 of Act No. 435/2004 Coll., on Employment. This provision allows employers to meet their obligations while also supporting companies that employ people with disabilities.
Definition of Persons with Disabilities
According to § 67 of Act No. 435/2004 Coll., persons with disabilities are defined as individuals who are granted enhanced protection in the labor market. This protection includes support for job searches, the creation of special job positions, and other measures.
